Karnataka PDO Result

Kar PDO GPS Cut Off Marks 2021 exam analysis
Here, we are providing the expected cut off score for Paper 1 and Paper 2 of the PDO and GPS examination Below.
As we know the examination was divided into 2 parts. The paper 1 included the multiple choice questions from General Knowledge, General Kannada, General English while paper 2 had questions from Rural Development and Panchayat Raj.
Each paper had 100 questions. Every correct answer will be awarded 2 marks. Hence, it makes 200 marks paper for each. As there is no Negative marking, it will affect the cutoff score.

His replay was.
Re exam is not possible in this case and the maximum we can make them delete the controversial questions.
So re exam is not possible at all.
He added. If you file case again in high Court you will be sent back to decide it in KAT. Because KAT has not given the exact judgment to the case it has given KEA a chance to make things clear and you have also agreed for the same.
If KEA again gives wrong answer you may again file the case on the Questions and fight for the justice

ವಾದವನ್ನು ನ್ಯಾಯಾದೀಶರ ಮುಂದೆ ಮಂಡಿಸಿದವು . ಕೆಎಟಿ ತಾನು ಮಂಡಿಸಿದ ವಾದದ ಭಾಗವೇ ಅದು ಸಲ್ಲಿಸಿದ ಅಫಿಡವಿಟ್. ಈ ಅಫಿಡವಿಟ್ಟಿನಲ್ಲಿ ಹೇಳಿದ ಅಂಶ ಕೆಎಟಿಯ ನಿಲುವು. ಇದೇ ರೀತಿ ದೂರುದಾರ ಅಭ್ಯರ್ಥಿಗಳು ತಮ್ಮ ನಿಲುವನ್ನು ನ್ಯಾಯಾಧೀಶ ಮುಂದೆ ಸ್ಪಷ್ಟಪಡಿಸಿದರು. ಇವೆರಡನ್ನೂ ಪರಿಶೀಲಿಸಿ ತೀರ್ಪು ನೀಡುವ ಕೆಲಸ ಈಗ ಕೆಎಟಿಯದ್ದು.
ಕೆಎಟಿ ತಾನು ನೀಡಿದ ತೀರ್ಪಿನಲ್ಲಿ ಎರಡೂ ಪಾರ್ಟಿಗಳ ವಾದವನ್ನು ಬದಿಗಿರಿಸಿ ಬೇರೆಯದೇ ಆದೇಶ ನೀಡಿತು. ಸದರಿ ಪ್ರಶ್ನೆಗಳನ್ನು ಎಕ್ಸಪರ್ಟ್ ಕಮಿಟಿ ಅಭಿಪ್ರಾಯದಂತೆ ಅಂತಿಮಗೊಳಿಸಲು ಕೆಎಟಿ ಗೆ ನಿರ್ದೇಶನ ನೀಡಿ ಅದರ ಆಧಾರದಲ್ಲಿ ಮೆರಿಟ್ ಲಿಸ್ಟ್ ಪರಿಷ್ಕರಿಸಲು ಸ್ವಾತಂತ್ರ್ಯವನ್ನೂ ನೀಡಿತು. ಇದರ ಅರ್ಥ ಏನು? ಕೆಎಟಿ ತನ್ನ ಅಫಿಡವಿಟ್ ನಲ್ಲಿ ಹೇಳಿದಂತೆ ಮಾಡಬೇಕು ಎಂದೇ? ಅಲ್ಲ. ಇದರ ಅರ್ಥ, ಎರಡೂ ಪಾರ್ಟಿಗಳು ಹೇಳುವುದನ್ನು ಪರಿಗಣಿಸದೆ ಎಕ್ಸಪರ್ಟ್ ಕಮಿಟಿ ಅಭಿಪ್ರಾಯದಂತೆ ಮುಂದುವರಿಯಬೇಕು ಎಂಬುದು. ಈಗ ಏನಾಯಿತೆಂದರೆ ದೂರುದಾರರ ವಾದ, ದಾಖಲೆಗಳು ಮತ್ತು ಕೆಎಟಿಯ ವಾದ ಮತ್ತು ಅದು ನೀಡಿದ್ದ ಅಫಿಡವಿಟ್ ಎಲ್ಲವನ್ನೂ ಕೋರ್ಟು ಬದಿಗಿರಿಸಿತು. ತೀರ್ಪಿನ ಪ್ರಕಾರ ಕೋರ್ಟಿನ ಎದುರಿಗಿದ್ದ ಪ್ರಶ್ನೆಗಳನ್ನು ಎಕ್ಸಪರ್ಟ್ ಕಮಿಟಿ ಎದುರಿಗಿಡಬೇಕು ಅಷ್ಟೇ. ಅದು ಹೇಗೆ ಹೇಳುತ್ತದೋ ಹಾಗೆ ಮಾಡಬೇಕು. ಆದುದರಿಂದ ಆರ್ಗುಮೆಂಟ್ ಸಂದರ್ಭದಲ್ಲಿ ನೀಡಲಾಗಿದ್ದ ಎಲ್ಲ ದಾಖಲೆಗಳು, ಅಫಿಡವಿಟ್ಟುಗಳು ತಮ್ಮ ಬೆಲೆ ಕಳೆದುಕೊಂಡವು ಎಂದರ್ಥ.
ಈಗ ಕೆಇಎ ಕೋರ್ಟ್ ನಿರ್ದೇಶನದಂತೆ ಉತ್ತರಗಳನ್ನು ಅಂತಿಮಗೊಳಿಸುವ ಹಂತದಲ್ಲಿದೆ. ಎಷ್ಟು ಪ್ರಶ್ನೆಗಳು ಬದಲಾಗಿವೆ ಮತ್ತು ಅವು ಯಾವುವು ಎಂಬುದು ಕೆಇಎ ಪ್ರಕಟಣೆ ನಂತರವಷ್ಟೇ ತಿಳಿಯಬೇಕಿದೆ.

ಎಕ್ಸಪರ್ಟ್ ಕಮಿಟಿ ಪೈನಲ್ ಅಂತ ಹೇಳಿರೋದು ನಾನಲ್ಲ, ಕೆಎಟಿ. ಆಂದ್ರ ಪ್ರದೇಶದ ಪ್ರಕರಣದಲ್ಲಿ ಪ್ರಿಲಿಮ್ಸ್ ಮತ್ತು ಮೆಯಿನ್ಸ್ ಪರೀಕ್ಷೆ ಇತ್ತು. 6 ಪ್ರಶ್ನೆಗಳ ಬಗ್ಗೆ ದೂರು ಬಂದಾಗ ಎಕ್ಸಪರ್ಟ್ ಕಮಿಟಿ ಅಭಿಪ್ರಾಯ ಪಡೆಯಲು ಆದೇಶವಾಯಿತು. ಆ ಎಕ್ಸಪರ್ಟ್ ಕಮಿಟಿ ಪ್ರಶ್ನೆಗಳು ತಪ್ಪು ಎಂದಿತು. ಇದರ ಆದಾರದ ಮೇಲೆ ಕೋರ್ಟ್ ಆ 6 ಪ್ರಶ್ನೆಗಳನ್ನು ಕೈಬಿಡಲು ಆದೇಶಿಸಿತು. ರಿ ಎಕ್ಸಾಮ್ ಗೆ ಆಧೇಶಿಸಲಿಲ್ಲ. ಯಾವುದೇ ಮೆಂಬರನ್ನೂ ಬ್ಲ್ಯಾಕ್ ಲಿಸ್ಟ್ ಮಾಡಲಿಲ್ಲ. ಸೋ, ಪ್ರಶ್ನೆಗಳ ಅಂತಿಮ ಸ್ಥಿತಿಯನ್ನು ನಿರ್ಧರಿಸಿದ್ದರು ಎಕ್ಸಪರ್ಟ್ ಕಮಿಟಿಯೇ ಹೊರತು ಕೋರ್ಟ್ ಅಲ್ಲ. ಆರ್ಡರ್ ನ ಮತ್ತೊಮ್ಮೆ ಓದು. ಇಲ್ಲಿ ಪಿಡಿಒ ವಿಚಾರದಲ್ಲಿ ಸಹ ಎಕ್ಸಪರ್ಟ್ ಕಮಿಟಿ ಅಭಿಪ್ರಾಯ ಪಡೆಯಲು ತಿಳಿಸಲಾಗಿದೆ. ಇಲ್ಲಿ ಸಹ ಪ್ರಶ್ನೆಗಳು ತಪ್ಪು ಎಂದು ಎಕ್ಸಪರ್ಟ್ ಕಮಿಟಿ ಹೇಳಿದರೆ ಅವನ್ನು ಕೈಬಿಡಬಹುದು ಇಲ್ಲ ಗ್ರೇಸ್ ಕೊಡಬಹುದು. ಅದು ಕೆಎಟಿ ತನ್ನ ಪಟ್ಟಿ ಬಿಟ್ಟ ಮೇಲೆ ತಿಳಿಯುತ್ತದೆ. ಇನ್ನೊಂದು ವಿಷಯ,
ಪ್ರಶ್ನೆಗಳನ್ನು ಡಿಲೀಟ್ ಮಾಡಿವುದು ಅಥವ ಗ್ರೇಸ್ ಕೊಡುವುದು ಎರಡೂ ಒಂದೇ. ಡಿಲೀಟ್ ಮಾಡಿದರೆ ಪರೀಕ್ಷೆ ಬರೆದ ಎಲ್ಲರಿಗೂ ಮಾರ್ಕ್ಸ್ ಹೋಗುತ್ತೆ, ಗ್ರೇಸ್ ಕೊಟ್ಟರೆ ಎಲ್ಲರಿಗೂ ಮಾರ್ಕ್ಸ್ ಬರತ್ತೆ. ಪಟ್ಟಿಯಲ್ಲಿ ಯಾವುದೇ ಬದಲಾವಣೆ ಆಗುವುದಿಲ್ಲ.
ಆಂದ್ರ ಪ್ರದೇಶ ದ ಕೇಸಿನಲ್ಲಿ ಅವರು 6 ಪ್ರಶ್ನೆಗಳು ಇತ್ಯರ್ಥವಾಗುವ ಮೊದಲೇ ಮೆಯಿನ್ಸ್ ಮಾಡಿದರು. ಇದು ಒಂದು ರೀತಿ ಕಂಟೆಂಪ್ಟ್ ಆಫ್ ಕೋರ್ಟ್. ಅಲ್ಲದೆ ಮೆಯಿನ್ಸ್ ಅನ್ನು ಹಳೆಯ ಸಿಲಬಸ್ ಪ್ರಕಾರ ನಡೆಸಲಾಗಿತ್ತು. ಹೀಗಾಗಿ ಮೆಯಿನ್ಸ್ ಅನ್ನು ಮತ್ತೆ ನಡೆಸಲು ಆದೇಶಿಸಲಾಯಿತು. ಇದು ಅನಿವಾರ್ಯವಾಗಿತ್ತು. ಏಕೆಂದರೆ ಹೊಸದಾಗಿ 144 ಕ್ಕೆ ವ್ಯಾಲುಯೇಶನ್ ಆದಾಗ ಹೊಸದಾಗಿ ಸೇರಿದ ಕ್ಯಾಂಡಿಡೇಟ್ಸ್ ಗೆ ಅವಕಾಶ ಕೊಡಬೇಕಿತ್ತು ಮತ್ತು ಹೊಸ ಸಿಲಬಸ್ ಪ್ರಕಾರ ಮೆಯಿನ್ಸ್ ಆಗಬೇಕಿತ್ತು.
ಪಿಡಿಒ ಪರೀಕ್ಷೆಯಲ್ಲಿ ಮೆಯಿನ್ಸ್ ಇಲ್ಲ. ಹಾಗಾಗಿ ಇಲ್ಲಿ ಆಂದ್ರ ಕೇಸಿನಷ್ಟು ಜಟಿಲತೆ ಇಲ್ಲ. ನಡೆದಿರುವ ಪರೀಕ್ಷೆ ಬಹು ಆಯ್ಕೆ ಮಾದರಿಯದ್ದು. ಎರಡು ಪತ್ರಿಕೆಗಳು ಮತ್ತು 200 ಪ್ರಶ್ನೆಗಳು. ಮೊದಲಿನ ಪತ್ರಿಕೆ ಬಗ್ಗೆ ತಕರಾರಿಲ್ಲ. ಎರಡನೇ ಪತ್ರಿಕೆಯ ಕೆಲವು ಪ್ರಶ್ನೆಗಳ ಬಗ್ಗೆ ತಕರಾರಿದೆ. ಅವನ್ನು ಕೆಎಟಿ ಯಲ್ಲಿ ಪ್ರಶ್ನಿಸಲಾಗಿತ್ತು. ಎಕ್ಸಪರ್ಟ್ ಕಮಿಟಿ ಅಭಿಪ್ರಾಯ ಪಡೆದು ಅವನ್ನು ಅಂತಿಮಗೊಳಿಸಿ ಎಂದು ಹೇಳಿ ಕೆಎಟಿ ಆ ಅರ್ಜಿಗಳನ್ನು ಇತ್ಯರ್ಥಗೊಳಿಸಿದೆ. ಎಕ್ಸಪರ್ಟ್ ಕಮಿಟಿ ಒಪೀನಿಯನ್ ಪ್ರಕಾರ ಕೆಎಟಿ ಉತ್ತರಗಳನ್ನು ಅಂತಿಮಗೊಳಿಸಿ ಹೊಸ ಮೆರಿಟ್ ಲಿಸ್ಟ್ ಬಿಡಲಿದೆ. ಮತ್ತೆ ಕೋರ್ಟಿಗೆ ಹೋದರೆ ಯಾವ ಅಂಶಗಳು ಪರಿಶೀಲನೆಯಾಗುತ್ತವೆ ಎಂಬುದನ್ನು ನನ್ನ ಹಿಂದಿನ ಕಾಮೆಂಟಿನಲ್ಲಿ ವಿವರವಾಗಿ ಬರೆದಿದ್ದೇನೆ. ಕೋರ್ಟಿನ ನಿರ್ದೇಶನ ಪಾಲನೆಯಾಗಿದೆಯೇ ಎಂದು ಪರಿಶೀಲಿಸಲಾಗುತ್ತದೆ. ಅಂದರೆ ಹಿಂದೆ ಕೋರ್ಟಿನಲ್ಲಿದ್ದ ಪ್ರಶ್ನೆಗಳನ್ನು ಎಕ್ಸಪರ್ಟ್ ಕಮಿಟಿ ಮುಂದೆ ಇಟ್ಟು ಅದರ ಅಭಿಪ್ರಾಯದಂತೆ ಅಂತಿಮಗೊಳಿಸಲಾಗಿದೆಯೇ ಎಂದು ನೋಡಕಾಗುತ್ತದೆ. ಹಾಗೆ ಮಾಡಿದ್ದರೆ ಅಲ್ಲಿಗೆ ಕೇಸ್ ಮುಕ್ತಾಯ. ನೀವು ಬೇಕಾದರೆ ಅಪೀಲ್ ಹೋಗಬಹುದು. ಆಗಲೂ ಮೇಲಿನ ಕೋರ್ಟಿನಲ್ಲಿ ಏನಾಗತ್ತೆ ಅಂತ ನಾನು ವಿವರಿಸಬೇಕಾಗಿಲ್ಲ. ಎಲ್ಲರಿಗೂ ಸುಲಭವಾಗಿ ಅರ್ಥವಾಗುತ್ತದೆ.
ಒಂದು ವಿಷಯ ಎಲ್ಲರಿಗೂ ಅರ್ಥ ಆಗಬೇಕು. ಪ್ರಶ್ನೆಯೊಂದಕ್ಕೆ ಸರಿ ಉತ್ತರ ಯಾವುದು ಅಂತ ಯಾವ ಕೋರ್ಟ್ ಸಹ ಇಲ್ಲಿಯವರೆಗೆ ತೀರ್ಪು ಕೊಟ್ಟಿಲ್ಲ. ಇಂತಹ ಎಲ್ಲಾ ಸಂದರ್ಭಗಳಲ್ಲಿ ಎಕ್ಸಪರ್ಟ್ ಕಮಿಟಿ ಅಭಿಪ್ರಾಯ ಪಡೆಯಲು ಹೇಳಿ ಆ ಆಧಾರದಲ್ಲಿ ತೀರ್ಪು ನೀಡಿವೆ. ಹಾಗೆ ಮಾಡಲು ರೂಲ್ ಬುಕ್ಕಿನಲ್ಲಿ ಅವಕಾಶವೂ ಇಲ್ಲ. ಅಕ್ಯಾಡೆಮಿಕ್ ವಿಷಯಗಳಲ್ಲಿ ಕೋರ್ಟು ತನ್ನ ಸ್ವಂತ ಅಭಿಪ್ರಾಯ ಹೇರುವಂತಿಲ್ಲ ಎಂಬುದು ಸುಪ್ರೀಂ ಕೋರ್ಟ್ ಆದೇಶ. ಪಿಡಿಒ ಏನು ಈ ದೇಶದ ಪರೀಕ್ಷೆ ಅಲ್ವ? ಇದಕ್ಕೆ ಇಲ್ಲಿಯ ಕಾನೂನು ಅನ್ವಯ ಆಗಲ್ವ?
ಯಾರಿಗೆ ಅಸಮಾಧಾನ ಇದೆಯೋ ಅವರು ಕೋರ್ಟಿಗೆ ಹೋಗಿ. ಬೇಡಾ ಅನ್ನುತ್ತಿರುವವರು ಯಾರು? ನಿಮ್ಮ ವಾದ ನೀವು ಮಾಡಿ. ಕೆಎಟಿ ವಾದ ಕೆಎಟಿ ಮಾಡುತ್ತದೆ. ನಾವು ನಮ್ಮ ಸಪೋರ್ಟ್ ಏನಿದೆಯೋ ಅದನ್ನ ಕೊಡ್ತೀವಿ. ನಿಮ್ಮನ್ನ ಮೆಚ್ಚಿಸುವ ದರ್ದು ನನಗಿಲ್ಲ.
ಈ ಪೋಸ್ಟ್ ಗಳನ್ನು ನಾನು ಬರೆಯುತ್ತಿರುವುದಕ್ಕೆ ಕಾರಣ ಆತಂಕದಲ್ಲಿರುವ ಸಾವಿರಾರು ಅಭ್ಯರ್ಥಿಗಳಿಗೆ ವಾಸ್ತವಾಂಶಗಳನ್ನು ತಿಳಿಸಿ ಕೋರ್ಟಿಗೆ ಹೋದರೂ ತೊಂದರೆ ಇಲ್ಲ ಎಂದು ತಿಳಿಸುವುದ್ಟೇ…ಆದರೆ ಕೋರ್ಟಿಗೆ ಹೋಗತೀವಿ ಅಂತ ಇಲ್ಲಿ ಎಲ್ಲರನ್ನೂ ಹೆದರಿಸಲು ಪ್ರಯತ್ನಿಸುತ್ತಿರವ ಕೆಲವು ಧಗಾಕೋರರು ನನ್ನ ಪೋಸ್ಟ್ ಗಳಿಗೆ ವಿಪರೀತ ದಿಗಿಲುಬಿದ್ದು ಬಾಯಿ ಬಡಿದುಕೊಳ್ಳುತ್ತಿರುವುದೇಕೋ ನನಗೆ ಅರ್ಥ ಆಗುತ್ತಿಲ್ಲ.
ಕೆಎಟಿ ಇಂತಹ ಅನೇಕ ಪರೀಕ್ಷೆಗಳನ್ನು ಅನೇಕ ವರ್ಷಗಳಿಂದ ನಡೆಸುತ್ತಾ ಬಂದಿದೆ. ಅದಕ್ಕೆ ತನ್ನದೇ ಆದ ಕಾನೂನು ಕೋಶ ಇದೆ. ಪ್ರತೀ ಪರೀಕ್ಷೆಯಲ್ಲೂ ಒಂದಲ್ಲಾ ಒಂದು ಕೇಸ್ ಇದ್ದದ್ದೇ. ಪಿಡಿಒ ಕೇಸನ್ನು ಹ್ಯಾಂಡಲ್ ಮಾಡುತ್ತಿರುವ ರಮೇಶ್ ಸರ್ ಅವರೇ ಕೆಎಟಿ ಪರವಾಗಿ ಬೇರೆ ಬೇರೆ ಕೋರ್ಟುಗಳಲ್ಲಿ ಇಂತಹ ಬೇರೆ ಬೇರೆ ಕೇಸ್ಗಳನ್ನು ಬಡಿದಾಡಿ ಗೆದ್ದಿದ್ದಾರೆ. ಇದೇ ಅವರ ವೃತ್ತಿ. ಎದುರು ಪಾರ್ಟಿ ಲಾಯರುಗಳಿಗೆ ಹೇಗೆ ಕೆಎಟಿಯಲ್ಲಿ ತಕ್ಕ ಪ್ರತ್ಯುತ್ತರ ಕೊಟ್ಟರು ಎಂಬುದನ್ನು ನಾವೆಲ್ಲಾ ಸ್ವತಃ ನೋಡಿದ್ದೇವೆ. ಕೇವಲ ಆ್ಯಸ್ಪಿರೆಂಟ್ಸ್ ಆದ ನಮಗೇ ಈ ಪಿಡಿಒ ಕೇಸಲ್ಲಿ ಇಷ್ಟು ಆತ್ಮಸ್ಥೈರ್ಯದಿಂದ ಮಾತನಾಡಲು ಸಾಧ್ಯ ಎಂದಾದರೆ ಇದನ್ನೇ ವೃತ್ತಿಯಾಗಿಸಿಕೊಂಡಿರುವ ಕೆಎಟಿ ಲಾಯರ್ ಇನ್ನಷ್ಟು ಬಲವಾಗಿರಬೇಕು ಯೋಚಿಸಿ. ಹಾಗೂ ಒಂದು ವೇಳೆ ಅವರಿಗೆ ಕಷ್ಟವಾದರೆ ಆ್ಯಸ್ಪಿರೆಂಟ್ಸ್ ಕಡೆಯಿಂದ ಘಟಾನುಘಟಿ ಲಾಯರ್ ನೇಮಿಸಿ ರಮೇಶ ಸರ್ ಗೆ ಸಹಕರಿಸುತ್ತೇವೆ. ನೀವು ಕೋರ್ಟಿಗೆ ಹೋದರೆ ಆ್ಯಸ್ಪಿರೆಂಟ್ಸ್ ಸಹ ಪಾರ್ಟಿ ಆಗುತ್ತೇವೆ. ಸೋ ನಿಮ್ಮ ವಿರುದ್ಧ ಹೋರಾಡುವವರು ಕೆಎಟಿ ಲಾಯರ್ ಮತ್ತು ಆ್ಯಸ್ಪಿರೆಂಟ್ಸ್ ಪರ ಲಾಯರ್. ನೀವು ಯಾವ ಕೋರ್ಟಿಗೆ ಬೇಕಾದರೂ ಹೋಗಿ …ಇಲ್ಲಾರಿಗೂ ಭಯವಿಲ್ಲಾssssss……

ಆಂದ್ರ ಪ್ರದೇಶ ಪಬ್ಲಿಕ್ ಸರ್ವೀಸ್ ಕಮಿಷನ್ ನಡೆಸಿದ ಸಿವಿಲ್ ಸರ್ವಿಸ್ ಪರೀಕ್ಷೆಯ ಪ್ರಿಲಿಂಮ್ಸ್ ನಲ್ಲಿ 150 ಪ್ರಶ್ನೆಗಳ ಪೈಕಿ 6 ಪ್ರಶ್ನೆಗಳು ತಪ್ಪಾಗಿವೆ ಎಂದು ಕೆಲವರು ಕೋರ್ಟಿಗೆ ಹೋದರು. ಈ ವ್ಯಾಜ್ಯ ಇನ್ನೂ ಬಾಕಿ ಇರುವಾಗಲೇ ಮೆಯಿನ್ಸ್ ಪರೀಕ್ಷೆಗೆ ನೋಟಿಫಿಕೇಷನ್ ಹೊರಡಿಸಲಾಯಿತು. ಮತ್ತು ಈ ಮೆಯಿನ್ಸ್ ಪರೀಕ್ಷೆಯನ್ನು ಹಳೇ ಸಿಲಬಸ್ ಪ್ರಕಾರ ನಡೆಸಿತು. ಆಗ ದೂರುದಾರರು ಮತ್ತೆ ಕೋರ್ಟಿಗೆ ಹೋದರು. ಪ್ರಿಲಿಮ್ಸ್ ನ 6 ಪ್ರಶ್ನೆಗಳ ವ್ಯಾಜ್ಯ ಇತ್ಯರ್ಥವಾಗದೆ ಮೆಯಿನ್ಸ್ ಪರೀಕ್ಷೆ ನಡೆಸಿದ್ದು ತಪ್ಪು ಎಂದು ಹೇಳಿದ ಕೋರ್ಟ್, ಎಕ್ಸಪರ್ಟ್ ಕಮಿಟಿ ರಚಿಸಿ ಈ ಆರು ಪ್ರಶ್ನೆಗಳ ಬಗ್ಗೆ ತೀರ್ಮಾನ ಕೈಗೊಳ್ಳುವಂತೆ ಹೇಳಿತು. ಪ್ರಶ್ನೆಗಳು ತಪ್ಪು ಎಂಬುದು ಕೋರ್ಟಿನಲ್ಲು ಸಾಬೀತಾಯಿತು. ಆದ ಕಾರಣ ಈ ಆರು ಪ್ರಶ್ನೆಗಳನ್ನು ಡಿಲೀಟ್ ಮಾಡಿ 144 ಕ್ಕೆ ಮೌಲ್ಯಮಾಪನ ಮಾಡುವಂತೆ ಕೋರ್ಟ್ ಹೇಳಿತು. ಇದರಿಂದಾಗಿ ಕೆಲ ಅಭ್ಯರ್ಥಿಗಳು ಹೊರಹೋದರು ಮತ್ತು ಕೆಲವರು ಒಳಗೆ ಬಂದರು. ಹೀಗಾದಾಗ ಈಗಾಗಲೇ ನಡೆಸಿರುವ ಮೆಯಿನ್ಸ್ ಪರೀಕ್ಷೆಗೆ ಯಾವುದೇ ಮಾನ್ಯತೆ ಇಲ್ಲದಾಗುವ ಕಾರಣ ಮೆಯಿನ್ಸ್ ಪರೀಕ್ಷೆಯನ್ನು ಹೊಸದಾಗಿ ನಡೆಸಲು ಕೋರ್ಟ್ ಸೂಚಿಸಿತು. ಅಲ್ಲದೆ, ಮೆಯಿನ್ಸ್ ಪರೀಕ್ಷೆಯನ್ನು ಹಳೆಯ ಸಿಲಬಸ್ ಪ್ರಕಾರ ನಡೆಸಲಾಗಿತ್ತು. ಈ ಎರಡು ಕಾರಣಗಳಿಗೆ ಮೆಯಿನ್ಸ್ ಪರೀಕ್ಷೆಯನ್ನು ಮತ್ತೆ ನಡೆಸಲು ಸೂಚಿಸಲಾಯಿತು. ಇದರ ಜೊತೆಗೆ, ತೆಲಂಗಾಣ ಹೊಸ ರಾಜ್ಯ ರಚನೆಯಾದ ಕಾರಣ ಎರಡೂ ರಾಜ್ಯಗಳು ಹೊಸ ಪ್ರತ್ಯೇಕ ಪರೀಕ್ಷೆ ನಡೆಸಿಕೊಳ್ಳಲು ಅವಕ್ಕೆ ಸ್ವಾತಂತ್ರ್ಯ ನೀಡಲಾಯಿತು.
ಇಲ್ಲಿ sandesh ಹೇಳುವಂತೆ ಪ್ರಶ್ನೆ ತಪ್ಪಾಗಿರುವುದಕ್ಕೆ ರಿಎಕ್ಸಾಮ್ ನಡೆದಿಲ್ಲ. ಪ್ರಿಲಿಮ್ಸ್ ರಿ ಎಕ್ಸಾಮ್ ಆಗಿಯೇ ಇಲ್ಲ. ಪ್ರಶ್ನೆ ತಪ್ಪು ಎಂದು ಸಾಬೀತಾದರೂ ಅವನ್ನು ಡಿಲೀಟ್ ಮಾಡಲು ಕೋರ್ಟ್ ಹೇಳಿದೆ. ಅವನ್ನು ಬಿಟ್ಟು ಮೌಲ್ಯಮಾಪನ ಮಾಡಲು ತಿಳಿಸಿದೆ. ಇದೆಲ್ಲ ಆಗದೆ ಮೆಯಿನ್ಸ್ ಪರೀಕ್ಷೆ ನಡೆಸಿದ ಕಾರಣ ಅದು ಸಹಜವಾಗಿಯೇ ಡಿಸ್ ಕ್ವಾಲಿಫೈ ಆಗಿದೆ. ಯಾವ ಎಕ್ಸಪರ್ಟ್ ಕಮಿಟಿ ಮೆಂಬರನ್ನೂ ಇಲ್ಲಿ ಬ್ಲ್ಯಾಕ್ ಲಿಸ್ಟ ಮಾಡಿಲ್ಲ.
ಈ ಕೇಸನ್ನ ನೋಡಿದ ಮೇಲೆ ನಮ್ಮ ಆತ್ಮವಿಶ್ವಾಸ ಮತ್ತಷ್ಟು ಹೆಚ್ಚಿದೆ. ಸುಪ್ರೀಂ ಕೋರ್ಟಿಗೆ ಹೋದರೂ ನಮಗೇ ಗೆಲುವು ಎಂಬುದು ಮತ್ತಷ್ಟು ದೃಡಪಟ್ಟಿದೆ
ಯಾರು ಕೋರ್ಟಿಗೆ ಹೋಗಬೇಕೋ ಹೋಗಿ. ನೀವು ಹೋಗಲೇಬೇಕು. ನಿಮಗೆ ಕೋರ್ಟಿನಲ್ಲೇ ಮಂಗಳಾರತಿ ಆಗೋದನ್ನ ನಾವು ನೋಡಬೇಕು. ಜೊತೆಗೆ ನಿಮಗೆ ಹಣ ಕೊಟ್ಟು ಮೋಸ ಹೋದವರು ನಿಮ್ಮನ್ನ ಅಟ್ಟಾಡಿಸಿಕೊಂಡು ಹೊಡೆಯೋದನ್ನು ನೋಡಬೇಕು. ಅದೆಲ್ಲ ಆಗ ಬೇಕು ಅಂದರೆ ನೀವು ಕೋರ್ಟಿಗೆ ಹೋಗಬೇಕು…

The controversy that stalled the recruitment of Group I posts in 2011 over six allegedly wrong answers in the key by the AP Public Service Commission for the preliminary examination has surfaced yet again before the Hyderabad High Court.
Though the PSCs of TS and AP have issued notifications to hold the Group I Main exam in September as per the old syllabus, and with relaxed age norms — for candidates who had appeared for the test in 2011 as per a Supreme Court order — some candidates who had passed the examination and even attended the interviews took up the matter with the High Court.
Their contention is that the earlier petitions are pending before the High Court for final disposal and that the Apex Court order is based on an interim order of the High Court; and that, without deciding on the issue, a fresh exam is unacceptable.
It’s 3 vs the rest
The dispute arose a couple of days before the date of commencement of the Group I Main exam. Three aspirants moved the AP administrative tribunal contending that the final answer key given by the APPSC for six questions for the preliminary exam was not correct and that conducting the main examination without rectifying the mistakes was illegal.
The tribunal too felt that answers for six questions were wrong. It then directed the APPSC to constitute an expert committee. It said that, after finalisation of the key by the expert committee, and if necessary, the selection process could be revised in accordance with the answer key arrived at by the expert committee.
As the tribunal refused to order a fresh examination as was sought by the petitioners, they moved the High Court. The High Court, while admitting the petitions, passed an interim order directing the secretary, UPSC, to constitute a committee to suggest the correct answers and submit a report within four weeks.
Aggrieved by the interim order, the APPSC moved the SC and it held that: “We are of the view that these questions cannot be retained. That being so, the marks secured have to be recounted from the answer books written by all the candidates on the basis of 144 questions after deleting these six questions and their answers.”
The SC then said those who pass the test after revaluation will be eligible for the Main examination and the APPSC will hold the main examination de novo. Later, the Supreme Court modified its earlier order when the APPSC sought a clarification with regard to participation of the candidates and their age relaxation.
The Supreme Court said: “We modify our order dated October 7, 2013 to this extent that it will be permissible for APPSC to restrict the participation in the May examination to be held now to approximately 10,000 candidates who have passed the fresh exam after excluding the above-referred 7,711 candidates. There will be age relaxation in favour of candidates who have crossed the age bar because of litigation.”
And when the petitioners before the High Court moved a case against the commission for delay and also in view of constituting a separate Public Service Commission for the state of Telangana, the SC passed an order on June 2 telling Telangana Public Service Commission to conduct the exam which should be based on syllabus as notified earlier while permitting both the states to conduct a fresh test within three months.

5. The relief sought by the Applicant is to declare answer
keys in respect of Questions No.33, 45, 47, 62, 74, 91 and 92
in relation to History Question Paper as incorrect and to direct
the KEA to revalue his answer book and award marks. This is
purely an academic matter and the decision of the expert
committee is final. The Hon’ble Supreme Court has
repeatedly held that court cannot substitute its own views for
that of the examiners and award marks in exercise of powers
of judicial review as these are purely academic matters.

ಕೆಎಟಿ ಹೇಳಿರೋದು ಕೇಸ್ ಹಾಕಲಾಗಿದ್ದ ಎಲ್ಲಾ ಪ್ರಶ್ನೆಗಳನ್ನು ಎಕ್ಸಪರ್ಟ್ ಕಮಿಟಿ ಅಭಿಪ್ರಾಯ ಪಡೆದು ಫೈನಲ್ ಮಾಡಿ ಎಂದು. ಇಲ್ಲಿ ಅಭ್ಯರ್ಥಿಗಳ ಅಭಿಪ್ರಾಯ ಅಗತ್ಯವಿಲ್ಲ. ಅದನ್ನು ಕೊಡುವಂತೆಯೂ ಇಲ್ಲ. ಯಾವುದೇ ಕಾರಣಕ್ಕೆ ಕೆಇಎ ಕರ್ತವ್ಯದಲ್ಲಿ ಈ ಹಂತದಲ್ಲಿ ಯಾರೂ ಮೂಗು ತೂರಿಸುವಂತಿಲ್ಲ. ಹಾಗೆಅಡಿದರೆ ಅದು ಕಂಟೆಂಪ್ಟ್ ಆಫ್ ಕೋರ್ಟ್ ಆಗುತ್ತದೆ.
ಮತ್ತೊಂದು ವಿಚಾರ… ಕೋರ್ಟ್ಗೆ ಹೋಗಿದ್ದ ಪ್ರಶ್ನೆಗಳನ್ನು ಮಾತ್ರ ಪರಿಷ್ಕರಿಸಲು ಕೆಎಟಿ ಆದೇಶ ಇರುವುದು. ಹಾಗಾಗಿ ಹೊಸ ಪ್ರಶ್ನೆಗಳನ್ನು ಈಗ ಎತ್ತುವಂತಿಲ್ಲ. ಹಾಗೆ ಮಾಡಿದರೆ ಅದೂ ಸಹ ಕಂಟೆಂಪ್ಟ್ ಆಫ್ ಕೋರ್ಟ್ ಆಗುತ್ತದೆ.
ಕೆಎಟಿ ಆದೇಶದಂತೆ ಕೆಇಎ ಕ್ರಮ ಕೈಗೊಳ್ಳುತ್ತದೆ. ಪಟ್ಟಿ ಬರುವ ಮೊದಲೇ ಸುಳ್ಳು ಸುದ್ದಿ ಹರಡುವುದೂ ಸಹ ಅಪರಾಧವೇ.
ಪಟ್ಟಿ ಬಂದ ಮೇಲೂ ಅಸಮಾಧಾನ ಇದ್ದರೆ ಕೋರ್ಟಿಗೆ ಹೋಗಬಹುದು. ಈ ವಿಚಾರವನ್ನು ಇಲ್ಲಿ ವಿಶ್ಲೇಷಿಸೋಣ. ಹೈ ಕೋರ್ಟಿಗೆ ಹೋದರೆ ಏನಾಗಬಹುದು? ಈ ಹಿಂದೆ ಕೆಎಟಿಯಲ್ಲಿ ಈ ಪ್ರಕರಣ ಬಂದಿದ್ದರಿಂದ ಮತ್ತೆ ಅಲ್ಲಿಗೇ ಹೋಗಿ ಎಂದು ಹೇಳಿ ಅರ್ಜಿ ವಜಾಗೊಳಿಸಬಹುದು. ಅಥವ ಅರ್ಜಿಯನ್ನು ವಿಚಾರಣೆಗೆ ಅಂಗೀಕರಿಸಲೂಬಹುದು. ಆದರೆ ಕೆಎಟಿ ಹೋಗುವಂತೆ ಸೂಚಿಸುವ ಸಾಧ್ಯತೆಯೇ ಅಧಿಕ.
ಮತ್ತೆ ಕೆಎಟಿ ಗೆ ಬಂದರೆ ಅಲ್ಲೇನಾಗಬಹುಪ್ರೂ ತನ್ನ ಹಿಂದಿನ ತೀರ್ಪು ಪಾಲನೆಯಾಗಿದೆಯೇ ಎಂದು ಮೊದಲು ಪರಿಶೀಲಿಸಲಾಗುತ್ತದೆ. ಆಗ ಕೆಇಎ ತಾನು ಅನುಸರಿಸಿದ ಮಾರ್ಗವನ್ನು ಕೆಎಟಿಗೆ ವಿವರಿಸುತ್ತದೆ. ಎಕ್ಸಪರ್ಟ್ ಕಮಿಟಿ ಅಭಿಪ್ರಾಯ ಪಡದು ಉತ್ತರ ಅಂತಿಮಗೊಳಿಸಲಾಗಿದೆ ಎಂದು ಕೋರ್ಟಿಗೆ ಮನವರಿಕೆಯಾದರೆ ಅಲ್ಲಿಗೆ ಕೆಇಎ ಗೆ ಬಹುಪಾಲು ಗೆಲುವಾದಂತೆ. ಅಸಿಸ್ಟೆಂಟ್ ಪ್ರೊಫೆಸರ್ ಪರೀಕ್ಷೆ ಪ್ರಕರಣದಲ್ಲಿ ಇದೇ ಕೆಎಟಿ ತಳೆದ ನಿಲುವಿನ ಆಧಾರದಲ್ಲಿ ಹೀಗಾಗಬಹುದು ಎಂದು ಹೇಳುತ್ತಿದ್ದೇನೆ. ಏಕೆಂದರೆ ಅಭ್ಯರ್ಥಿಗಳು ಏನೇ ಪ್ರೂಫ್ ನೀಡಿದರೂ ಎಕ್ಸಪರ್ಟ್ ಕಮಿಟಿ ಒಪೀನಿಯನ್ ಅಂತಿಮ ಎಂದು ಇದೇ ಕೆಎಟಿ ತನ್ನ ಹಿಂದಿನ ಆದೇಶಗಳಲ್ಲಿ ಹೇಳಿದೆ. ಸುಪ್ರೀಂ ಕೋರ್ಟ್ ಸಹ ಇದನ್ನೇ ಹೇಳಿದೆ.
ಒಂದು ವೇಳೆ ಹೈಕೋರ್ಟಿನಲ್ಲಿ ಪ್ರಕರಣ ವಿಚಾರಣೆಗೆ ಬಂದರೆ ಆಗಲೂ ಕೆಎಟಿ ತೀರ್ಪಿನಂತೆ ನಡೆದುಕೊಂಡಿದ್ದೇವೆ ಎಂದು ಕೆಇಎ ಮನವರಿಕೆ ಮಾಡಿಕೊಟ್ಡರೆ ಬಹುಪಾಲು ಜಯವಾದಂತೆ. ಮುಂದುವರಿದು, ಸುಪ್ರೀಂ ಕೋರ್ಟಿನ ತೀರ್ಪು ಹೈಕೋರ್ಟಿಗೂ ಅನ್ವಯವಾಗುವುದರಿಂದ ಎಕ್ಸಪರ್ಟ್ ಕಮಿಟಿ ಅಭಿಪ್ರಾಯಕ್ಕೇ ಅಲ್ಲೂ ಮಾನ್ಯತೆ. ದೂರುದಾರರು ಎಷ್ಟೇ ಹೋರಾಡಿದರೂ ಅಡ್ಜರ್ನ್ ಮಾಡಿಸಬಹುದಷ್ಟೇ… ಆದರೆ ಪಿಡಿಒ ನೇಮಕಾತಿ ಪ್ರಕ್ರಿಯೆ ಅಬಾಧಿತವಾಗಿ ಮುಂದುವರಿಯುತ್ತದೆ.
ಯಾರೂ ಬಯಪಡುವ ಅಗತ್ಯವಿಲ್ಲ. ಕೋರ್ಟಿಗೆ ಹೋಗುವವರು ಹೋಗಲಿ.
